How is the horse in other ways?
How is his ground manners on line?
Do you know what I mean by being braced?
How much control do you have of his hind quarters?
How are his leads? Do you have any trouble picking up either lead? Does the horse drop his shoulder loping circles in either lead?

I'm guesing you have a spoiled 9 year old tat has found a way to cheat you. Problem is he's found the best way -dangerous and hard to cure. I'm pretty hard on counterfits, and rearing is way counterfit. On an aged horse - one that knows better - I'd set him up and try to pull him over (step over to 1 stirrup) then I'd sit on his head til he was wondering if he was ever getting up. When he did get up I'd try to set him up again.

He might need a good trading off, as evidenced by his brands.
