Omaha man charged with fetal homicide

OMAHA — Bail was set at $1 million Tuesday for an Omaha man charged with fetal homicide.

Delayno Shackelford, 19, waived his preliminary hearing and was bound over to Douglas County District Court. No hearing dates were set, however.

He has been charged with murder of an unborn child, attempted first-degree assault and false imprisonment. Gary Olson, an attorney from the public defender’s office, was appointed to represent Shackelford.

Shackelford was arrested Friday after Omaha police investigated an assault on Crystal Lilly, 18, who was eight months pregnant.

In court Tuesday, a prosecutor said Shackelford had picked up Lilly, threw her on a bed, straddled her and choked her.

Lilly went to Mercy Hospital in Council Bluffs, Iowa, with severe abdominal pain several hours after the assault, which police say happened between 2 a.m. and 3 a.m. Friday.

Lilly delivered a girl who was stillborn.

Shackelford was arrested later Friday on suspicion of domestic assault. Autopsy results Saturday showed that head trauma was the likely cause of death of the girl.

Lilly and Shackelford shared an apartment and had a long-standing relationship, according to Shackelford’s brother, Peere Shackelford. The couple already has one child together.

Nebraska’s fetal homicide law, passed in 2002, provides for a criminal charge if a fetus dies when a pregnant woman is assaulted or injured.

I wonder how long a society can survive without fair and equitable justis?
